CHERRY VALLEY – State Senator Dave Syverson (R-Cherry Valley) is celebrating the signing of legislation that cracks down on squatters and strengthens protections for property owners.
“For years, I’ve been advocating for legislation like this because I’ve seen firsthand how damaging these situations can be,” said Sen. Syverson. “Too often, vulnerable residents—especially seniors—return from a vacation or hospital stay to find their home unlawfully occupied. The emotional and financial toll is devastating, and until now, the law has lacked a clear path for help. This bill changes that. It gives police the authority to act swiftly and gives property owners the protection they deserve.”
Sen. Syverson was a supporter of SB1563 and has long championed property rights. In 2024, he introduced similar legislation under SB 3658 to address the growing issue of squatters unlawfully occupying homes.
Senate Bill 1563, now signed into law, will allow police to immediately remove squatters from a property without a required court-ordered eviction. Law enforcement will now be able to enforce criminal trespassing charges in cases where an individual is unlawfully occupying a home.
Previously, Illinois law made no distinction between overstaying tenants and squatters, even if a squatter falsely claimed to be a tenant or owner. That meant property owners often had to wait out a lengthy court eviction process before reclaiming their homes, even in cases of clear unlawful occupation.
The new law takes effect January 1, 2026.
